If you feel that you have enough reasons which amount to such a breakdown in a relationship between you and your current solicitors that effective representation can no longer be provided, then you should proceed to make an Application to Transfer Solicitors. The Court will send the form to your current solicitor and ask for their comments. Once they have considered their response they will make a decision. This usually takes about weeks so it is very important to do this early.

In some circumstances, where it is no fault of your own, they may make an urgent decision. This means that the Court has considered all the circumstances and decided that it is possible for you to move forward with you current firm representing you.

This is a final decision and you should immediately contact your existing firm to try and work out a way to continue preparation for trial. It is very unlikely that the firm will treat you badly as a result of an Application to Change Solicitor. This means that your legal aid will be transferred to Tuckers Solicitors who will be keen to start working and preparing your case. They will be entitled to all of the prosecution papers in your case and your old solicitors are likely to assist with relevant information which has already been served on the Court.

It might take weeks to gather all of this information before Tuckers can have an effective appointment with you to take your full instructions. Again, this is a reason that would be used by your solicitor. This covers all other reasons that do not fall under the categories mentioned above.

These reasons will come under high scrutiny by the Judge. If your application is granted, then the new firm will be entitled to access to all the Prosecution papers and your old firm may provide further information to assist. There might be a delay in your new solicitors contacting you to make an appointment as it can take some time before these documents are made accessible to them. Unfortunately, if your request to transfer solicitors is refused you will have to continue being represented by your current firm.

You should not be treated any different and the firm may try and fix the issue by allocating your case to a different solicitor within the company. If the issues persist, you can try and make another application to transfer but unless there is a significant change in circumstances it will most likely be refused again. If you are able to fund your case privately , you can revoke your legal aid order and instruct a firm of your choice.

It is important to bear in mind that if your case is successful, you will not be entitled to court costs as you were initially eligible for legal aid.
